I. Terms of Use

  1. Introduction. These terms and conditions govern your use of the website www.resurfacingprojects.com.au (“Website”) and all the services, features, content and products available on the Website. Please read these terms and conditions carefully before using the Website. By accessing or using the Website, you agree to be bound by these terms and conditions and our Privacy Policy. If you do not agree to these terms and conditions, please do not use the Website.
  2.  Use of the Website. The Website is for your personal, non-commercial use. You may not use the Website for any commercial purpose or for any other purpose not reasonably intended by Resurfacing Projects. You may not use the Website in any manner that could damage, disable, overburden or impair the Website or interfere with any other party’s use and enjoyment of the Website. You may not attempt to gain unauthorised access to any part of the Website, other accounts, computer systems or networks connected to the Website, through hacking, password mining or any other means.
  3. Intellectual Property Rights. All content available on the Website, including but not limited to text, graphics, logos, images, and software, is the property of Resurfacing Projects or its licensors and is protected by copyright, trademark and other intellectual property laws. You may not use any content from the Website for commercial purposes without obtaining a license from Resurfacing Projects or its licensors.
  4. Disclaimers The Website is provided on an “as is” and “as available” basis. Resurfacing Projects makes no representations or warranties of any kind, express or implied, as to the operation of the Website or the information, content, materials or products included on the Website. Resurfacing Projects will not be liable for any damages of any kind arising from the use of the Website, including but not limited to direct, indirect, incidental, punitive and consequential damages.
  5. Changes to the Terms and Conditions. Resurfacing Projects reserves the right to change these terms and conditions at any time without prior notice. Your continued use of the Website after any changes to these terms and conditions will be deemed to be your acceptance of those changes.
  6. Governing Law. These terms and conditions are governed by the laws of the state of New South Walse, Australia.

II. Payments

  1. Invoicing and Payments. Invoices will be issued upon completion of the services or delivery of the products.  Payment is due in 3 days from the date of invoice or as stated on invoice. Any payment not received by the due date will be subject to a late payment fee daily interest rate for every day that the payment amount is overdue.
  2. Late payment interest rates. 2% daily interest rate for invoices under $1500; 1% daily interest rate for invoices above $1500
  3. Accepted Methods of Payment. We accept payment via bank transfer, Credit Card/Debit Card (card surcharge apply), PayPal and cash. Bank transfer is preferred payment method.
  4. Currency. All invoices and payments must be made in Australian Dollars.
  5. Disputes. In the event of a dispute regarding the amount of the invoice, the customer must notify us in writing within 3 days of the invoice date. Failure to do so will result in the customer waiving their right to dispute the invoice.
  6. Default. In the event of default, we reserve the right to charge interest on the outstanding balance. We may also take legal action to recover the debt, and the customer will be responsible for all costs associated with such action.
  7. Changes to Payment Terms. We reserve the right to change these payment terms at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new payment terms.

III. Deposit

  1.  Purpose. This Deposit Policy outlines the terms and conditions under which deposits are accepted and processed by Resurfacing Projects. By submitting a deposit, customers acknowledge and agree to abide by the terms herein.
  2. Deposit Requirement. Deposit is required to secure [specific product/service] provided by Resurfacing Projects. The deposit amount will be clearly communicated to the customer at the time of booking or purchase.
  3. Acceptable Payment Methods. Deposits can be made via accepted payment methods, including credit/debit cards, bank transfers, etc.
  4.  Deposit Deadline. The deposit must be paid by the specified deadline to confirm the booking or purchase. Failure to submit the deposit by the deadline may result in the forfeiture of the booking or purchase.
  5. Non-Refundable Nature. Deposits are non-refundable under any circumstances, including but not limited to cancellation or no-show. This policy applies regardless of the reason for cancellation or failure to utilise the product or service.
  6. Transferability. Deposits are non-transferable to third parties.
  7. Exceptional Circumstances. In rare cases of extenuating circumstances, Resurfacing Projects may, at its sole discretion, consider refunding or transferring deposits. Such considerations will be evaluated on a case-by-case basis and are not guaranteed.
  8. Booking or Purchase Confirmation. The booking or purchase will be confirmed only upon receipt of the non-refundable deposit and any necessary documentation or information required by Resurfacing Projects.
  9. Final Payment. The remaining balance of the total cost must be paid by the specified deadline, as communicated by Resurfacing Projects. Failure to do so may result in the cancellation of the booking or purchase, with the forfeiture of the deposit.
  10. Modification of Terms. Resurfacing Projects reserves the right to modify or amend this Deposit Policy at any time without prior notice. Any changes will be effective immediately upon posting on www.resurfacingprojects.com.au website or other communication channels.
  11. Agreement. By submitting a deposit, customers acknowledge that they have read, understood, and agree to abide by the terms and conditions outlined in this Deposit Policy.

IV. Warranty

Resurfacing Projects warrants that all work we perform will be free from de-lamination, (cracking, peeling, or any workmanship defect not caused by neglect or mistreatment on the part of the customer), from the date of completion for a period of FIVE years (owner occupied) and THREE years (investment/rental property) warranty. If any of our work does require repair and falls within the limits of this warranty, all work and materials will be supplied at no additional cost.

If the surface blisters, peels or cracks, Resurfacing Projects must be notified of such defect immediately, failing to do so may result in the warranty being voided.

Please note bathtub mats CANNOT be used on resurfaced bathtub as it will damage the coating. We offer a slip resistant bottom surface as an accessory option to our bathtub resurfacing service.

Warranty given by Resurfacing Projects is NOT transferable to third parties.

This warranty covers peeling, cracking or other failures of applied coating and is subject to the following conditions. 

Resurfacing Projects will NOT be liable for:

  1. Damage caused by direct impact from an object, misuse or mistreatment that caused the surface to chip, scratch or crack, either accidentally or intentionally.
  2. Damage caused by plumbing problems, leaking taps, shower doors, mildew of caulk, problems caused from shower/bath mats, bathtub trays/bridges, structural conditions or movement of fixtures, tile or grout or caulk.
  3. Damage caused by the use of abrasives such as: scorers, comet, scrubbing sponges, steel wool, sandpaper or any other gritty objects or cleaners.
  4. Damage caused by the use of an abrasive cleaners in powder or cream form which may include but not limited to: Comet, Ajax, Gumption or ANY other abrasive cleaners, acids, toilet bowl cleaners, etc.
  5. Damage caused by objects placed on the refinished surface such as: bathtub mats, soap dishes, adhesive tapes, adhesive hooks or any similar products that can damage the coating. We offer a slip resistant surface as an accessory option to our bathtub service.
  6. Damage/stains caused by hair dyes, chemicals, mineral build-up or rust.
  7. Damage caused by continuously leaking/dripping taps.
  8. Damage caused by bathing pets.
  9. Any scratching, deterioration of the glossy finish or staining over time due to usage, cleaning practices or water conditions will be considered normal wear and tear.
  10. For on-site spraying/resurfacing only: Resurfacing Projects is not responsible for dust particles that may land onto surface while the new finish is drying. Most particles caught in the drying topcoat will be removed naturally in the process of normal cleaning.

Warranty does not cover floor resurfacing, vanity top and soap holder resurfacing, resurfacing over previously coated/painted surface, caulking and rust repairs.
